These Terms and Conditions ("Terms") govern access to and use of the site amaneceraustral.com (the "Site") and the professional services provided by Amanecer Austral SpA ("Amanecer Austral", "we" or "the agency").
By browsing the Site, creating an account, submitting a form or engaging our services, you represent that you have read, understood and accepted these Terms.
1. Acceptance of the Terms
These Terms constitute an agreement between you and Amanecer Austral. If you do not agree with any part of them, we ask that you refrain from using the Site or our services.
Certain specific services (sale mandates, property management, expat legal advice) are additionally governed by specific contracts signed separately. In the event of a conflict between these Terms and a signed contract, the latter prevails for the specific relationship it governs.

In compliance with Chilean law and the transparency requirements applicable to online services accessible from the European Union (Directive 2000/31/EC on e-commerce and the DSA Regulation EU 2022/2065), we disclose:

For clients resident in the European Union: we market properties located in Chile and provide them with real-estate services from Chile on a cross-border basis. The sale is perfected and governed by Chilean law (see Section 16), without prejudice to any mandatory consumer rights the client retains in their country of residence.
3. Services we offer
Amanecer Austral is a boutique real-estate agency. We offer the following services:
- Sale and purchase brokerage of residential and investment properties.
- Professional appraisal with international methodology.
- Property Management — comprehensive management of properties for non-residents (see Section 9).
- Expat legal advice (DL 1.939) — guidance for foreigners buying in Chile.
- Concierge & Relocation — settling in, schooling, residency.
- Interior Design & Staging — design and value enhancement for sale or rental.
We market properties located exclusively in southern Chile, with openness to other locations within the country. We do not broker properties outside Chile. We serve domestic and international buyers looking to invest in southern Chile.
Our catalog is deliberately small (≤ 20 active properties globally) because every mandate is known and visited by the agency. We do not list what we do not know.
4. Real-estate disclaimers {#disclaimers-inmobiliarios}
4.1 Information provided "as is"
The information published on the Site (descriptions, photographs, floor plans, areas, views, approximate location) is provided "as is" and comes from the owner, public information or visual inspection by the agency. Although we verify it with reasonable diligence, we do not guarantee its absolute accuracy.
4.2 Buyer responsibility / due diligence
Before signing any promise of sale or contract, the buyer is responsible for:
- Conducting legal due diligence (title study, encumbrances, mortgages, easements).
- Conducting technical due diligence (physical inspection, updated topographic survey, verification of areas).
- Verifying the zoning plan, land uses, environmental restrictions and building permits with the municipality and the Internal Revenue Service (SII).
- Validating the tax status of the property (property taxes up to date, successions, inheritances).
Amanecer Austral can coordinate these analyses through professionals in its network, but the final decision and responsibility rest with the buyer.
4.3 Prices and currencies
Prices are expressed in UF (Unidad de Fomento) as the canonical unit of the Chilean market, with reference conversion to CLP, USD, EUR and BRL updated daily. The reference price does not constitute a binding offer unless it appears in a proposal signed by the parties.
4.4 Availability
Published properties may change status without prior notice. We are available to confirm the availability and status of each mandate in real time.
4.5 Owner privacy
The exact address of each property is provided only after coordinating a visit and confirming the identity of the interested party, in protection of the owner.
5. Commissions, conflicts of interest and representation {#comisiones}
5.1 Brokerage commissions
Our commissions are customary in the Chilean market:

Every commission is agreed in writing prior to the provision of the service.
5.2 Representation scheme
We operate predominantly under seller representation (listing-side brokerage). When we also represent the buyer in the same transaction ("dual representation"), we declare it explicitly and in writing before proceeding, and obtain the consent of both parties.
5.3 Conflicts of interest
We explicitly declare:
- We do not receive hidden commissions from recommended suppliers (lawyers, notaries, appraisers, contractors).
- If we recommend a supplier who is a business partner or relative of the team, we declare it in writing.
- We do not participate as a disguised final buyer in mandates we receive.
- We treat all confidential information received during a mandate with strict confidentiality, even after the relationship ends.
5.4 Exclusivity clause
Some mandates may require an exclusivity clause for a defined period. This is agreed explicitly and in writing with the owner.
6. AML / KYC — Anti-Money-Laundering Prevention {#aml-kyc}
6.1 Legal framework
We apply the requirements of:
- Chile: Law 19.913 (Financial Analysis Unit, UAF), which designates real-estate brokers as obligated parties when handling transactions above a certain threshold.
- European Union: AML Directives (5AMLD, 6AMLD), applicable when a client resides or holds bank accounts in a member state.
- United Kingdom: Money Laundering Regulations 2017.
6.2 Identification procedures
For transactions of a certain size or complexity, we request:
- Identity: valid identity card or passport.
- Proof of address: recent utility bill, bank statement or official document.
- Source of funds: declaration of the origin of the money used for the transaction (salary, sale of another asset, inheritance, dividends, etc.).
- Ultimate beneficial owner: for legal entities, identify the natural person who effectively controls the entity (when they hold ≥25% or exercise de facto control).
- Politically Exposed Person (PEP): declaration if the client or a direct family member holds or has held a relevant public office.
6.3 Reporting of suspicious transactions
If, during a transaction, we detect objective indications of money laundering, we are legally obligated to report to the Chilean UAF (or the equivalent authority in other jurisdictions), without any obligation to notify the client.
6.4 Reserved right to refuse
We reserve the right to refuse or suspend a transaction if:
- The KYC documentation provided is insufficient or unverifiable.
- The source of funds cannot be reasonably substantiated.
- The client appears on international sanctions lists (see Section 7).
- There are objective red flags that the agency considers prudent not to ignore.
7. Compliance with international sanctions {#sanciones}
Before accepting a mandate or representing a client in a transaction, we screen against the following lists:
- OFAC (Office of Foreign Assets Control, United States)
- European Union consolidated sanctions
- United Nations consolidated sanctions list
- HMT (HM Treasury, United Kingdom) and the Swiss authorities (SECO) where applicable
We do not provide services to persons or entities included in these lists, nor to transactions involving countries or sectors under comprehensive sanctions.
If a sanction applies after a mandate has begun, we must suspend it immediately and report it to the relevant authorities.
8. Anti-Discrimination Policy {#no-discriminacion}
Amanecer Austral is committed to non-discrimination. We serve clients without regard to:
- Race, ethnicity, national or ancestral origin.
- Religion or beliefs.
- Gender, gender identity or sexual orientation.
- Age (over 18), marital status or family composition.
- Physical or intellectual disability.
- Political or union opinion.
This applies to both buyers and sellers. If an owner requests buyer-selection criteria that we consider discriminatory under applicable law (Chile: Ley Zamudio; EU: Directive 2000/43/EC; U.S. analogues to the Fair Housing Act), we do not accept the mandate under those terms.
Reasonable exceptions (limiting reservations to validly registered residents, for example) must have documented legal grounds.
9. Property Management {#property-management}
The Property Management service is governed by a separate specific contract. Summary of the standard scope:
- Preventive and corrective maintenance of the property: garden, pool, systems, cleaning.
- Tenant management (if the property is offered for rent): selection, contracts, collection, reconciliation.
- Coordination of local suppliers.
- Monthly reports to the owner with photos, status and accounting movements.
- Payment of bills and obligations (utilities, property taxes, common expenses) under specific power of attorney.
Standard fees: a percentage of the rent when there is an active lease + an initial setup fee. Details in each contract.
The service may be suspended or terminated with the notice period defined in the specific contract.
10. Intellectual property
All Site content (texts, photographs, videos, code, design, trademarks, logos) is the property of Amanecer Austral SpA or of third parties who have authorized its use. It is protected by Chilean Intellectual Property Law 17.336, the EU InfoSoc Directive 2001/29/EC and applicable international treaties.
Property photographs include a boutique watermark and a diagonal micro-tile. We do not authorize their use, reproduction or redistribution without written consent.
The "Amanecer Austral" trademark and the associated isotype are in the process of registration with INAPI (Chile).
11. Visitor account
To facilitate the tracking of properties of interest, we offer visitor accounts created via OAuth (Google, Apple, Facebook).
- The account is personal and non-transferable.
- You are responsible for maintaining the confidentiality of the credentials of the OAuth provider used.
- We may suspend or close accounts that we detect as fake, automated or in breach of these Terms.
- You may request the closure and deletion of your account at any time from

12. Email communications
When you contact us, we reply by transactional email via Resend. If you voluntarily subscribe to the editorial newsletter, we apply a double opt-in (email confirmation) before sending content.
You may unsubscribe at any time from the link at the foot of any email or by writing to privacidad@amaneceraustral.com.
13. Limitation of liability
To the maximum extent permitted by applicable law:
- Amanecer Austral does not guarantee the uninterrupted availability of the Site. We may temporarily suspend the service for maintenance, updates or force majeure.
- We are not liable for indirect damages, loss of profit or loss of business opportunities arising from use of the Site.
- In relation to the provision of professional services, our liability is limited to the amount of the commission actually received in the relevant transaction, except in cases of willful misconduct or gross negligence.
- We are not liable for the conduct of third parties (sellers, buyers, notaries, banks), nor for contractual breaches between the parties we bring into contact.
Nothing in this section excludes or limits liabilities that by law cannot be limited (e.g. willful misconduct, personal injury, non-waivable consumer rights).
14. Modification of the Terms
We may update these Terms to reflect legal, operational or technological changes. The "last updated" date at the top reflects the current version. For substantial changes we will give notice via a banner on the site or an email to those with an active account.
Continued use of the Site after an update implies acceptance of the new Terms.
15. Complaints procedure {#reclamos}

15.4 Mediation
Before initiating legal action, the parties undertake to attempt mediation in good faith within 30 days. If no agreement is reached, the judicial route remains available.
16. Governing law and jurisdiction
- Governing law: unless a mandatory rule provides otherwise, these Terms are governed by the laws of the Republic of Chile.
- Jurisdiction: the parties agree to submit disputes to the ordinary courts of Puerto Montt, Los Lagos Region, Chile.
- EU consumer exception: if you are a consumer with habitual residence in an EU member state, you retain the right to invoke the protection of the mandatory rules of your country of residence and to sue in your local courts, pursuant to the Rome I and Brussels I bis Regulations.
17. Miscellaneous
- Assignment: you may not assign your rights or obligations under these Terms without our written consent. We may assign them to a business successor with prior notice.
- Severability: if any clause is held void or unenforceable, the remaining clauses retain full force.
- Language: the Spanish version is the authentic version. Translations into English, Portuguese and German are provided for convenience.
